專利申請到專利授予要多久?
專利申請(qing)到專利授予(yu)需要(yao)的時間(jian)如下:
1.發明專利(li)申請(qing)(qing)經(jing)初步審(shen)查和(he)實質審(shen)查沒有發現(xian)駁回理由(you)的(de),專利(li)局將作出授(shou)(shou)權決定(ding),發給(gei)專利(li)證書,并予以登記和(he)公告。發明專利(li)自申請(qing)(qing)至授(shou)(shou)權約需(xu)3~5年左右時(shi)間。
2.實(shi)用新型專(zhuan)利(li)(li)申請(qing)經初步審查(cha)沒有發(fa)現(xian)駁回理由(you)的,專(zhuan)利(li)(li)局將(jiang)作出授權決(jue)定(ding),發(fa)給專(zhuan)利(li)(li)證(zheng)書(shu),并予以登記(ji)和公告。實(shi)用新型專(zhuan)利(li)(li)自(zi)申請(qing)至授權約需6~10個月(yue)左右時間。
3.外觀(guan)設計專利申請(qing)經初步(bu)審查沒有(you)發現駁回理由的,專利局將作出授(shou)(shou)權決定,發給專利證書,并予以(yi)登記和(he)公告。外觀(guan)設計專利自申請(qing)至授(shou)(shou)權約需(xu)6~8個(ge)月左右時間。
