專利申請到專利授予要多久?
專利(li)申請到(dao)專利(li)授予需(xu)要的時(shi)間如下:
1.發(fa)明(ming)專(zhuan)利申請經初步審查(cha)和實質審查(cha)沒有發(fa)現駁回理由的(de),專(zhuan)利局將(jiang)作出授權(quan)決定,發(fa)給專(zhuan)利證書,并予以登記和公(gong)告(gao)。發(fa)明(ming)專(zhuan)利自申請至(zhi)授權(quan)約需(xu)3~5年(nian)左右時間。
2.實(shi)用新(xin)型(xing)專利(li)(li)申(shen)請經初步(bu)審查沒有發現駁回(hui)理(li)由的(de),專利(li)(li)局將(jiang)作出授(shou)權決定(ding),發給專利(li)(li)證(zheng)書,并予以(yi)登記和公告。實(shi)用新(xin)型(xing)專利(li)(li)自申(shen)請至(zhi)授(shou)權約需(xu)6~10個月左右時間。
3.外觀設計專(zhuan)利申請(qing)(qing)經初步審查沒有發現駁(bo)回理由的(de),專(zhuan)利局將作(zuo)出授(shou)(shou)權(quan)(quan)決(jue)定,發給專(zhuan)利證書,并予以登(deng)記和公告。外觀設計專(zhuan)利自申請(qing)(qing)至授(shou)(shou)權(quan)(quan)約需6~8個月左右(you)時間。
