恢復專利權有的期限
當事人因(yin)不可抗拒的(de)(de)事由(you)而延誤專(zhuan)利法或(huo)者(zhe)本細則規定(ding)的(de)(de)期限(xian)或(huo)者(zhe)國(guo)(guo)務院專(zhuan)利行政部門指(zhi)定(ding)的(de)(de)期限(xian),導致其權利喪失(shi)的(de)(de),自障礙(ai)消除之(zhi)日(ri)起2個月(yue)內,最遲自期限(xian)屆滿之(zhi)日(ri)起2年內,可以向國(guo)(guo)務院專(zhuan)利行政部門請求恢復(fu)權利。
除(chu)前款規(gui)定的情形外,當事人因其他正(zheng)當理由延誤專利(li)法或者(zhe)本細則規(gui)定的期限或者(zhe)國(guo)務(wu)院(yuan)專利(li)行政部(bu)(bu)門指定的期限,導致(zhi)其權(quan)利(li)喪失(shi)的,可以自收到國(guo)務(wu)院(yuan)專利(li)行政部(bu)(bu)門的通知(zhi)之日起(qi)2個月內(nei)向國(guo)務(wu)院(yuan)專利(li)行政部(bu)(bu)門請求(qiu)恢復權(quan)利(li)。
《專利法實施細則》第六(liu)條 當事(shi)人因(yin)不可抗(kang)拒的(de)(de)事(shi)由而延(yan)誤專利法或者本細則規定的(de)(de)期(qi)限或者國務院(yuan)專利行(xing)政(zheng)部門指定的(de)(de)期(qi)限,導致(zhi)其權(quan)利喪失的(de)(de),自(zi)障礙消除之日(ri)起(qi)2個月內,最遲自(zi)期(qi)限屆滿之日(ri)起(qi)2年內,可以(yi)向(xiang)國務院(yuan)專利行(xing)政(zheng)部門請求恢復權(quan)利。
當事人依照本條第一款或者第二款的(de)規(gui)定請(qing)(qing)(qing)求(qiu)(qiu)恢復權利(li)的(de),應(ying)當提交恢復權利(li)請(qing)(qing)(qing)求(qiu)(qiu)書,說(shuo)明理(li)由,必要時附具有關證明文件,并辦(ban)(ban)理(li)權利(li)喪失前應(ying)當辦(ban)(ban)理(li)的(de)相應(ying)手續;依照本條第二款的(de)規(gui)定請(qing)(qing)(qing)求(qiu)(qiu)恢復權利(li)的(de),還應(ying)當繳納恢復權利(li)請(qing)(qing)(qing)求(qiu)(qiu)費(fei)。
第十九條 商標代理(li)(li)機構應當遵循誠(cheng)實信用(yong)原則,遵守(shou)法律、行政法規,按照被代理(li)(li)人的委托辦理(li)(li)商標注冊申(shen)請或者其(qi)他商標事宜;對在(zai)代理(li)(li)過程中知悉(xi)的被代理(li)(li)人的商業秘密(mi),負有保密(mi)義務。
委托(tuo)人(ren)申請注冊的商(shang)標可能存在本法規(gui)定不得(de)注冊情形的,商(shang)標代理(li)機構應當明確告知委托(tuo)人(ren)。
商標代理機構(gou)知道或(huo)者應(ying)當知道委托人(ren)申請注冊的商標屬(shu)于(yu)本法第(di)四條、第(di)十五條和第(di)三(san)十二(er)條規(gui)定情形的,不(bu)得接受其(qi)委托。
商(shang)標代理機構除對其代理服務(wu)申(shen)請(qing)商(shang)標注冊外,不得申(shen)請(qing)注冊其他商(shang)標。
