擅用“熱血江湖”標識被判賠償50余萬元

日前,北京市海淀區人民法(fa)院針(zhen)對(dui)原告北京中(zhong)清龍(long)(long)圖網絡技術有限公(gong)(gong)(gong)司(si)訴被告朗(lang)天(海南自(zi)貿區)網絡科(ke)技有限公(gong)(gong)(gong)司(si)、上饒(rao)市千騰網絡科(ke)技有限公(gong)(gong)(gong)司(si)侵犯(fan)(fan)商(shang)標(biao)權及(ji)不正當競爭糾紛案作出一審判(pan)決(jue),認(ren)定朗(lang)天公(gong)(gong)(gong)司(si)在對(dui)涉案游戲(xi)的推(tui)廣(guang)中(zhong)使(shi)用“熱血江湖”標(biao)識(shi)的行為侵犯(fan)(fan)了中(zhong)清龍(long)(long)圖公(gong)(gong)(gong)司(si)商(shang)標(biao)權,宣稱(cheng)“正版授權”構成虛假宣傳(chuan),判(pan)決(jue)朗(lang)天公(gong)(gong)(gong)司(si)賠償中(zhong)清龍(long)(long)圖公(gong)(gong)(gong)司(si)經濟損失及(ji)合理開支50余(yu)萬元。
法院經審理認(ren)為(wei),該(gai)案(an)中,朗(lang)(lang)天公(gong)(gong)(gong)司(si)(si)(si)使(shi)用(yong)的(de)“熱(re)(re)血江(jiang)湖”標(biao)識與中清(qing)(qing)龍圖公(gong)(gong)(gong)司(si)(si)(si)的(de)“熱(re)(re)血江(jiang)湖”商標(biao)除字體外,呼(hu)叫(jiao)、文字均一致,二者構成近似(si)商標(biao)。中清(qing)(qing)龍圖公(gong)(gong)(gong)司(si)(si)(si)“熱(re)(re)血江(jiang)湖”注冊(ce)商標(biao)的(de)核定使(shi)用(yong)范圍是第(di)(di)9類(lei)計算機(ji)軟件等和(he)第(di)(di)41類(lei)游(you)戲(xi)等類(lei)別(bie),朗(lang)(lang)天公(gong)(gong)(gong)司(si)(si)(si)使(shi)用(yong)“熱(re)(re)血江(jiang)湖”與第(di)(di)9類(lei)、第(di)(di)41類(lei)的(de)商品或服務類(lei)別(bie)構成相(xiang)(xiang)同類(lei)別(bie)。朗(lang)(lang)天公(gong)(gong)(gong)司(si)(si)(si)在(zai)對涉案(an)游(you)戲(xi)的(de)推廣中使(shi)用(yong)“熱(re)(re)血江(jiang)湖”,該(gai)行(xing)為(wei)易造成相(xiang)(xiang)關公(gong)(gong)(gong)眾混(hun)淆,構成商標(biao)侵(qin)權(quan)行(xing)為(wei)。朗(lang)(lang)天公(gong)(gong)(gong)司(si)(si)(si)宣稱“正(zheng)版授(shou)權(quan)”,但卻自認(ren)其游(you)戲(xi)安裝包來源于網絡(luo),構成虛假宣傳(chuan)。
綜上,法(fa)院(yuan)作出上述(shu)判決。目前,該(gai)審判決已生效(xiao)。

商(shang)標(biao)不僅有識(shi)別商(shang)品來源的(de)(de)(de)(de)功能(neng),同時也具有保證(zheng)商(shang)品品質(zhi)、廣告(gao)宣(xuan)傳等功能(neng)。經(jing)營(ying)(ying)者(zhe)(zhe)應(ying)注(zhu)意避免(mian)使用與(yu)他(ta)人注(zhu)冊(ce)商(shang)標(biao)相(xiang)同或近似的(de)(de)(de)(de)標(biao)識(shi),防止商(shang)標(biao)侵權的(de)(de)(de)(de)發生(sheng)。宣(xuan)傳行(xing)為(wei)(wei)亦是經(jing)營(ying)(ying)者(zhe)(zhe)重(zhong)要的(de)(de)(de)(de)營(ying)(ying)銷手(shou)段之(zhi)一,而虛假宣(xuan)傳行(xing)為(wei)(wei)是指(zhi)經(jing)營(ying)(ying)者(zhe)(zhe)利用廣告(gao)或其(qi)(qi)他(ta)方法虛構事實,隱瞞真(zhen)相(xiang),造成(cheng)消費者(zhe)(zhe)和(he)用戶對(dui)其(qi)(qi)商(shang)品或服務的(de)(de)(de)(de)誤(wu)解,從而與(yu)之(zhi)進(jin)行(xing)交易,贏(ying)得市場,獲取利益(yi)的(de)(de)(de)(de)行(xing)為(wei)(wei)。經(jing)營(ying)(ying)者(zhe)(zhe)在宣(xuan)傳和(he)商(shang)業行(xing)為(wei)(wei)中(zhong)應(ying)注(zhu)意不因自身行(xing)為(wei)(wei)損害競爭對(dui)手(shou)的(de)(de)(de)(de)權益(yi),應(ying)注(zhu)重(zhong)維護公平競爭的(de)(de)(de)(de)市場環(huan)境。
