擅用“熱血江湖”標識被判賠償50余萬元

日前(qian),北京市海(hai)淀(dian)區人民(min)法院針對原告北京中清龍圖(tu)(tu)網(wang)絡技(ji)術有(you)(you)限公(gong)司(si)(si)訴被告朗天(tian)(海(hai)南自貿區)網(wang)絡科(ke)技(ji)有(you)(you)限公(gong)司(si)(si)、上(shang)饒市千騰網(wang)絡科(ke)技(ji)有(you)(you)限公(gong)司(si)(si)侵(qin)(qin)犯商標權及(ji)不正當競爭糾紛案作出(chu)一審判決(jue),認定朗天(tian)公(gong)司(si)(si)在對涉(she)案游戲的(de)推廣中使用(yong)“熱(re)血江(jiang)湖”標識的(de)行為侵(qin)(qin)犯了中清龍圖(tu)(tu)公(gong)司(si)(si)商標權,宣稱“正版授權”構(gou)成虛假(jia)宣傳,判決(jue)朗天(tian)公(gong)司(si)(si)賠償(chang)中清龍圖(tu)(tu)公(gong)司(si)(si)經濟(ji)損失及(ji)合理開支(zhi)50余(yu)萬元。
法院經審理認為(wei)(wei),該案中(zhong),朗(lang)天(tian)公(gong)(gong)(gong)(gong)司(si)使(shi)用(yong)的(de)“熱血(xue)江(jiang)(jiang)(jiang)湖”標識與中(zhong)清龍圖(tu)公(gong)(gong)(gong)(gong)司(si)的(de)“熱血(xue)江(jiang)(jiang)(jiang)湖”商(shang)(shang)標除字體外,呼(hu)叫、文(wen)字均一致,二者構(gou)成(cheng)近似商(shang)(shang)標。中(zhong)清龍圖(tu)公(gong)(gong)(gong)(gong)司(si)“熱血(xue)江(jiang)(jiang)(jiang)湖”注冊商(shang)(shang)標的(de)核定使(shi)用(yong)范圍是第(di)9類(lei)(lei)(lei)計算(suan)機軟(ruan)件等和第(di)41類(lei)(lei)(lei)游戲(xi)等類(lei)(lei)(lei)別(bie)(bie),朗(lang)天(tian)公(gong)(gong)(gong)(gong)司(si)使(shi)用(yong)“熱血(xue)江(jiang)(jiang)(jiang)湖”與第(di)9類(lei)(lei)(lei)、第(di)41類(lei)(lei)(lei)的(de)商(shang)(shang)品或服務類(lei)(lei)(lei)別(bie)(bie)構(gou)成(cheng)相(xiang)同類(lei)(lei)(lei)別(bie)(bie)。朗(lang)天(tian)公(gong)(gong)(gong)(gong)司(si)在對涉案游戲(xi)的(de)推廣中(zhong)使(shi)用(yong)“熱血(xue)江(jiang)(jiang)(jiang)湖”,該行(xing)為(wei)(wei)易(yi)造成(cheng)相(xiang)關公(gong)(gong)(gong)(gong)眾混淆,構(gou)成(cheng)商(shang)(shang)標侵權(quan)行(xing)為(wei)(wei)。朗(lang)天(tian)公(gong)(gong)(gong)(gong)司(si)宣稱“正版授權(quan)”,但卻自認其(qi)游戲(xi)安裝(zhuang)包來源于網絡,構(gou)成(cheng)虛(xu)假宣傳(chuan)。
綜上,法院作出(chu)上述判決(jue)。目前,該審判決(jue)已生效。
